In a flurry on 2 am e-mails we determined that a criminal prosecution would bar a federal civil rights claim until completion of the prosecution. They could tie us up for 2 years at this rate. Tim went to the airport unarmed and was not harassed in any way. However he filed a federal civil rights suit alleging that the airport used their authority to illegally deprive him of his property and his civil rights and violate state law in the process. Mayor Franklin and Mr. Decosta were served at their press conference.
Decosta was very polite to the people with "guns save lives" buttons. He came over and said that he has no problem with firearms but it creates too many concerns at the worlds busiest airport. He spoke to us when we served him and he promised to his his lawyers contact us immediately. He's looking forward to a ruling. I got the impression he's more afraid of Atlanta irrational stand then a court ordering him to do what is right.
Mayor Franklin is another story. She refused to accept process. Under federal law it doesn't matter she was served she just doesn't have the benefit of a copy of the pleadings. Her attitude was entirely that she was above the law. She has even posted to a AJC story with comments that she will continue this fight.
